What happens
A study for the German Tenants' Association found 46% of advertised existing flats in Berlin breach the rent cap, and a third exceed the threshold for rent gouging. For furnished flats in Berlin, 69% of listings breached the rent cap; the study analysed more than 20,000 online listings from May 2024 to October 2025. Of 339 cases the Berlin rent-check office could assess in 2025, it found an unlawful rent in 94%. In 222 of those cases the rent was more than 50% above the local comparative rent, raising suspicion of rent gouging.
